Paris Convention Treaty Filing

The following information is provided to assist our foreign associates with filling an application under the Paris Convention Treaty.  Our Office's location in Ottawa allows us to ensure that applications are filed the same day in which instructions are received.

Basic requirements

An English or French language translation of the application.

Additional information

Entity status

A small entity in respect of an invention, means an entity that employs 50 or fewer employees or that is a university, but does not include an entity that

    1. has transferred or licensed, or is under a contractual or other legal obligation to transfer or license, any right in the invention to an entity, other than a university, that employs more than 50 employees, or

    2. has transferred or licensed, or is under a contractual or other legal obligation to transfer or licence, any right in the invention to an entity that employs 50 or fewer employees or that is a university, and has knowledge of any subsequent transfer or license of, or of any subsisting contractual or other legal obligation to transfer or license, any right in the invention to an entity, other than a university, that employs more than 50 employees.

Examination

Examination does not automatically occur in Canada, instead it must be requested and the prescribed fee paid within 5 years of the filing date of the application.

Filing fees

Basic national fee:*

    1. if the applicant is a small entity     $200.00
    2. if the applicant is a large entity      $400.00
* does not include professional services for effecting filing

PCT - National Phase Entry in Canada

The following information is provided to assist our foreign associate's with entering national phase in Canada.  Our office's location in Ottawa allows us to ensure that PCT applications enter national phase in Canada on the same day in which instructions are received.

Time limits

30 months from the priority date of the application under Chapter I and II
Late entry can be initiated within 42 months from the priority date, accompanied by additional fee for late payment

Basic requirements

  1. If not published by the International Bureau, a copy of the International Application as filed.

  2. An English or French language translation of the International Application as amended during the International Phase.
